Can I legally own a nuke?
The only weapons that outright can't be possessed by citizens of the U.S. are what are known as CBRN weapons. Those are Chemical, Biological, Radiological, and Nuclear weapons. Also any machine gun not registered with the ATF prior to May 19th, 1986. Those are it.
Under the Atomic Energy Act, only the Department of Energy, the Department of Defense, and their contractors can produce or possess nuclear weapons.
Specifically, PC 11418(a) says anyone who "possesses, develops, manufactures, produces, transfers, acquires, or retains" a weapon of mass destruction is committing a crime. Deploying a WMD in California for any reason is a severe offense.
Basic weight is about 700 pounds (320 kg), although the weights of individual weapons may vary depending on version and fuze/retardation configuration. As of 2020, it is undergoing a 12th modification. According to the Federation of American Scientists in 2012, the roughly 400 B61-12s will cost $28 million apiece.

The nuclear-weapon states (NWS) are the five states—China, France, Russia, the United Kingdom, and the United States—officially recognized as possessing nuclear weapons by the NPT.
Given the immense and indiscriminate destructive power of nuclear weapons and their wide-ranging catastrophic humanitarian consequences, the use of nuclear weapons would constitute a war crime under several of the provisions outlined in the Rome Statute.
Possessing a destructive device is illegal in California, if it can be proven in court who it belongs to and that the person knew it was a destructive device.

Obtaining a nuclear weapon from a country's stockpile is hard to do—but not impossible. To date, no nuclear bomb has been known to have been stolen, and most are held in highly secure military sites. A terrorist group could also try to build a nuclear bomb using stolen highly-enriched uranium or plutonium.
Why are nukes banned?
Why do we need to ban nuclear weapons? Nuclear weapons should be banned because they have unacceptable humanitarian consequences and pose a threat to humanity. The simple reality is that the international community could never hope to deal with the impact of nuclear weapons use.
Death, starvation, radiation poisoning, and 3rd-degree burns
A single nuclear weapon can easily wipe out an entire city, Kathryn Higley, a professor of nuclear science at Oregon State University, told Insider.

However, Supreme Court rulings make clear that the Second Amendment is no refuge for American citizens to "keep and bear" nuclear weapons (or indeed many other types of "dangerous and unusual weapons" that are not "in common use at the time").
